There are four important factors that influence the development of customary law. These factors are:
1. Magic and animism;
2. religion;
3. Higher powers of the alliance customary law, and
4. Relationships with people or foreign powers.

1. Factors magic and animism:
On indigenous and tribal peoples, magic and animism this factor influence is so great and not or can not be pressured by the religions that came later. This is apparent in the implementation intentions-execution ceremony that originates in the belief in supernatural power or powers that can be requested assistance.
2. Religion Factor:
The influence of religion that goes then to Indonesia and embraced by the indigenous peoples concerned, such as Hinduism, Islam, and Christianity.
3. Higher power factor than traditional law partnership:
Higher power than traditional alliance is the power that has a larger area than customary law union as the Kingdom and the State.
4. Hukungan with people or foreign power:
This factor has a great effect. Even foreign powers which causes urgency customary law of some areas of the law of life. In addition, the nature of Western thought brought by foreigners (the West) in Indonesia and the foreign powers in legal relationships, influence the development of the Indonesian way of thinking. For example, it can be argued individualisering process in cities that run faster than rural communities.
